These Terms of Service ("Terms") govern your access to and use of the Protokol mobile application and related services (the "Service"), provided by MyPalate Technologies ("we," "us," "our"). By creating an account or using Protokol, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract in your jurisdiction to use Protokol. By using the Service you represent that you meet these requirements.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@protokolapp.ca if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
3. Not medical advice
Protokol is a self-tracking utility, not a medical device, not a pharmacy, and not a healthcare provider. The Service:
- Does not diagnose, treat, cure, or prevent any disease or condition.
- Does not recommend specific compounds, doses, or protocols for you.
- Does not verify the safety, legality, sourcing, purity, or appropriateness of any compound you log.
- Does not replace consultation with a licensed physician, pharmacist, or other qualified healthcare professional.
Reference data displayed in the Service (compound information, biomarker ranges, interaction notes, educational content) is provided for informational purposes only. It may be incomplete, outdated, or incorrect. Do not rely on it for medical decisions. Always consult a qualified professional and follow the laws of your jurisdiction.
4. Your content and data
You retain ownership of the data you log in Protokol (your "Content"). You grant us a limited, worldwide, royalty-free license to host, store, process, transmit, and display your Content solely as necessary to operate the Service for you. We do not claim ownership of your Content and do not use it for advertising or sell it to third parties.
You are solely responsible for the accuracy and legality of the Content you submit.
5. Acceptable use
You agree not to:
- Use the Service in violation of any applicable law or regulation.
- Use the Service to facilitate the sale, distribution, or sourcing of controlled substances or prescription medications.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by applicable law.
- Probe, scan, or test the vulnerability of our infrastructure without authorization.
- Access the Service through automated means (bots, scrapers) without our written permission.
- Upload viruses, malware, or content that violates the rights of others.
- Impersonate any person or misrepresent your affiliation with any entity.
- Resell, sublicense, or commercially exploit the Service without our written permission.
We reserve the right to suspend or terminate accounts that violate these rules.
6. Subscriptions and payments
Protokol is free to use at launch. Optional premium features may be offered through in-app purchases or subscriptions billed by Apple through the App Store. Pricing, renewal, cancellation, and refund policies for subscriptions are governed by your App Store account and Apple's terms. To cancel, manage your subscription in your Apple ID settings.
7. Third-party services
Protokol uses third-party services including Apple App Store, Apple Health, Google Firebase (Authentication, Firestore, Cloud Functions, Analytics, Crashlytics), and may use third-party AI providers for opt-in premium features. Your use of those services is also governed by their respective terms and privacy policies.
8. Intellectual property
The Service, including its software, design, logos, and content (other than your Content), is owned by MyPalate Technologies and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, SAFETY, EFFICACY, OR LEGALITY OF ANY COMPOUND, DOSE, PROTOCOL, OR BIOMARKER REFERENCE INFORMATION DISPLAYED IN THE SERVICE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYPALATE TECHNOLOGIES, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR HEALTH OUTCOMES, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
11. Indemnification
You agree to defend, indemnify, and hold harmless MyPalate Technologies and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your Content, your violation of these Terms, or your violation of any law or third-party right.
12. Termination
You may stop using the Service and delete your account at any time from within the App. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms or to comply with legal obligations. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.
13. Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You and we agree that the courts located in Vancouver, British Columbia shall have exclusive jurisdiction over any dispute arising from or related to these Terms or the Service, except where prohibited by applicable law.
14. Changes
We may update these Terms from time to time. Material changes will be communicated through the App or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
